BUSINESS PERMIT RENEWAL REQUIREMENTS  IN QUEZON CITY

A.      Full compliance with previous clearance requirements. Locational Clearance in 2015

B.      Payment of business taxes based on gross sales. Be ready to show proof of gross sales in 2015.

1)      Renewing the Mayor's Permit to do business requires the prior payment of business taxes based on gross sales. The computation of business tax due an establishment is based on rates prescribed in the Quezon City Revenue Code and its amendatory ordinances.
2)      The process for renewing the permit and paying the tax starts with filling out the Gross Sales Declaration Form in two (2) copies. The owner must sign the form; if unable to do so, it must be signed by his duly authorized representative (in which case, a letter of authorization must be presented).

ORIGINAL DOCUMENTS TO BE SUBMITTED BY BUSINESS TAXPAYER TO SUPPORT SALES DECLARATION

1)      Business Permit 2015
2)      Tax Bill and Official Receipt received from the City Treasurer's Office, 2015
3)      BIR Certificate of Registration
4)      Complete set of Audited Financial Statements (FS) FY of previous year
5)      Income Tax Returns FY 2014 filed in April 2015, with proof of payment
6)      Quarterly income tax returns 2015, with proof of payment Value Added Tax Returns/ Percentage Tax Returns FY 2015, whichever is applicable
7)      Latest Letter of Confirmation (LOC), if applicable Certified breakdown of sales, if there are two or more lines of business, in the case of consolidated statements

ADDITIONAL REQUIREMENTS FOR QC BUSINESSES WITH OPERATIONS OUTSIDE QUEZON CITY 

1)      2016 Community Tax Certificate for businesses outside Quezon City 2016
2)   Proof of business tax payment or Tax Bill issued by other local governments (LGUs) where other operations are situated


Basis for Evaluation of Gross Sales.

The business taxpayer must present the following documents (all original copies) to the authorized employees of the Inspection and Examination Division of the CTO, along with the two copies of the Gross Sales Declaration Form:

a. Mayor's Permit (immediately preceding year)
b. Latest Tax Bill and Official Receipt received from the City Treasurer's Office
c. Comparative set of Audited Financial Statements (FS) FY (for immediately preceding year and the years before), which must be signed by an accountant who is duly accredited by the Bureau of Internal Revenue, Board of Accountancy – Professional Regulation Commission (PRC), or the Securities and Exchange Commission
d. Income Tax Returns FY (immediately preceding year )
e. Value Added Tax Returns/ Percentage Tax Returns FY (immediately preceding year)
f. Latest Letter of Confirmation, if applicable
g. Breakdown of sales, if there are two or more lines of business, in the case of consolidated statements

Those who cannot provide credible proofs of gross sales, as in the documents (3) to (7) listed above, will be subject to the estimate of Gross Sales based on the Presumptive Income Level of Assessment Approach (PILAA). The PILAA is a tax tool which enables the local government unit to set a certain income level standard for various business entities based on industry factors. The Bureau of Local Government Finance (BLGF) cited the use of the PILAA in the case of First Planters Pawnshop, Inc. vs. City Treasurer of Pasay City [CTA (EB) No. 501, 10 December 2010], which provides that the PILAA may be used to compute LBT if the taxpayer is unable to provide proof of its income.


Obtaining the Renewed Mayor's Permit

Those renewing their business permits have to make sure that they have on hand the following documents:

a. Original copy of their previous year's Mayor's Permit for business (if not available, a photocopy will be acceptable)
b. Photocopy of machine-validated, current-year Official Receipt showing payment of business tax
c. Original copy of barangay clearance for current year
d. Other documents as required by the evaluator, such as:
1) Locational clearance (current year)
2) Fire safety inspection certificate (FSIC) (previous year)
3) Health certificate (previous year)
4) Sanitary permit (previous year)
5) Certificate of electrical inspection (previous year)
6) Mechanical permit (previous year)

After the taxpayer completes the above requirements, he is given a claim stub indicating the pick-up date for the renewed business permit, plate and sticker. The Mayor's Permit, together with the sticker indicating the current year, shall be made available for pickup at the BPLO transaction window.

a.     Security and Exchange Commission Registration: This government agency in the Philippines is in charge and in control for regulating and supervising the securities under partnership or corporation business industries in the Philippines.

Location: Export Department, SEC building, EDSA, Greenhills Mandaluyong city, Metro Manila Philippines
Main requirements: Articles of Partnership or Corporation & By laws

b.     Department of Trade and Industry: This government agency in the Philippines is in charge and in control for regulating and supervising the securities under sole proprietorship business industries in the Philippines.

Location: Trade and Industry Building, Sen Gil Puyat Avenue Makati, Metro Manila

* Processing fee depends on the scope of business

c.     Barangay Clearance: It is the required document for verifying of good moral character and good resident of a specific town or barangay that manifest the applicants that he/she doesn’t have a violation with the country’s law.

·      Processing fee: Php 200 (as of 2015)
·      Processing time: 1 hour

d.     Mayor’s Permit: This document can be requested in the municipality where the business is located.

·      Processing fee: Php 4000 (as of 2015)
·      Processing time: 2-3 hours

e.     Bureau of Internal Revenue: This agency accumulates all internal revenue taxes, charges and fees of a business

*Processing fee: Php 500 for TIN/Certificate

f.      Bureau of Customs: This is the bureau in control of imports and exports and foreign trade

g.     Social Security System (SSS), PHIL HEALTH: Is an agency that issues protection for the employees in the Philippines, which also gives incentives and benefits such as, sickness, maternity and funeral.

h.    Packing List: This comprises the content of the packaging, which is to be transported to another country or to be imported inside the country.

i.      Incoterm (Bill of Lading or Airway Bill): This is a document issued by a carrier, which details a shipment of merchandise and gives title of the shipment.

j.    Certificate of Origin: This is a document that includes information regarding the product’s location and country to be exported to.

k.   Export/Import Declaration: This gives out information and details of the import or export that can acquire from Department of Trade and Industry and should be submitted to the Bureau of Customs.

l.       Labeling and Marking – Accurate labeling ad marking should be done in the packaging. It includes the following:

·      Country of Origin
·       Port of entry
·      Weight
·      Shipping Mark
·      Quantity
·      Dimensions of the packaging
·      Handling Marks
  
Import Industry Requirements

Authorized to import: 

- Importers who are holders of bill of lading - Bill of lading is a document issued by a carrier, which details the shipment of merchandise and gives a title of shipment

- Licensed custom broker

- Valid license to operate (LTO Certificate) as importer, wholesaler importer or manufacturer importer

- Valid Certificate of Product Registration (CPR Certificate)



Kinds of Import entry

Informal entry
·      Products intended for sale or hire of which does not exceed the value of Php 2, 000.00

Formal entry
·      Products intended for sale or hire which exceed the value of Php 2, 000.00


Importer’s Clearance Certificate (ICC) Permit


ICC Permit Requirements as of January 2015

Application Form
·      Certified copy of the certificate of registration issued by Bureau
·      Certified copy of SEC or DTI registration
·      List of imports
·      Original copy of NBI Clearance
·      2 valid government ID

Processing Fee
·      All importers shall pay a processing fee of Php 1000 upon the submission of application

·      Revenue District Office – 10 working days
·      Regional Legal Division – 3 working days
·      Regional Collection Division – 3 working days
·      Accounts Receivable Monitoring Division – 3 working days

Reminder To All TAX Payers: Mandated to Pay Electronically

BIR to fine taxpayers who fail to file ITRs electronically


MANILA, Philippines - The Bureau of Internal Revenue will start penalizing taxpayers who are mandatorily required to  electronically file income tax returns (ITRs)  but fail to do so.
Among those required to use the eBIR forms in submitting tax returns are  accredited and prospective importers and brokers; national government agencies; licensed local contractors; recipients of fiscal incentives;  top 5,000 individual taxpayers, corporations with a paid up capital of P10 million and above; procuring government agencies, government bidders, large taxpayers and the top 20,000 private corporations.
Also mandated to file ITRs online are accredited tax practitioners and their clients, accredited printers of receipts, one-time transaction taxpayers, state-owned firms, local government units and cooperatives registered with the National Electrification Administration and Local Water Utilities Administration.
Delinquent taxpayers will be fined P1,000 per return.
Apart from this, civil penalties equivalent to 25 percent of the tax due to be paid shall also be imposed for filing a return in  a manner not in compliance with existing regulations...
